Welcome to Buddy.

These Terms of Service (“Terms”) govern your access to and use of the Buddy website, mobile applications, products and services (collectively, the “Service”).

The Service is operated by HSW HONG KONG CO. LIMITED (“Buddy”, “we”, “us”, or “our”).

By creating an account, accessing or using Buddy, you agree to these Terms and the policies referenced in these Terms.

If you do not agree with these Terms, you must not use Buddy.

About Buddy

Buddy is a global social discovery platform designed to help adults discover, connect and communicate with people nearby who may be interested in similar activities, experiences, friendships, travel, dating or other consensual adult connections.

Buddy may provide:

Buddy is a technology platform. We do not guarantee that you will find a particular person, receive a match, receive a response, meet another user or develop any particular relationship or connection.

• Social profiles
• User-generated posts
• Following and personalized feeds
• Nearby discovery
• Buddy matching
• Search
• Messaging
• Location-based features
• Activity discovery
• Premium features

Eligibility

Buddy is an 18+ platform.

You must be at least 18 years old, or the minimum legal age required to use Buddy in your jurisdiction, whichever is higher.

You must not use Buddy if you are prohibited from doing so under applicable law.

You represent that:

Buddy may suspend or terminate accounts where we reasonably believe that a user does not meet the applicable age requirement.

• You have the legal capacity to accept these Terms
• Information you provide is accurate
• You will comply with applicable laws.

Account

You are responsible for maintaining the security of your account and authentication information.

You must not:

• Use another person's identity without authorization
• Sell, rent or transfer your account
• Create accounts for fraudulent or abusive purposes

Nearby and Location

Buddy may use location information to provide:

Buddy is designed to provide useful proximity information without publicly displaying your precise location to other users.

Location functionality depends on device permissions and available location services.

Your use of location features is subject to the Privacy Policy.

• Activity discovery
• Travel-related discovery
• Location-based recommendations.

Matching and Recommendations

Buddy may recommend users based on factors including:

Recommendations are not endorsements, background checks, identity verification or guarantees of compatibility.

• Location
• Interests
• Activities

• Relationship intentions
• User interactions
• Availability
• Other signals used by Buddy's recommendation systems.

Messaging

Buddy may provide messaging and other communication features.

You are responsible for your communications with other users.

You must not use Buddy messaging to:

Buddy may investigate reports and use automated and/or human moderation systems where appropriate.

• Harass
• Threaten
• Scam
• Defraud
• Exploit
• Send malicious software
• Facilitate illegal activity
• Distribute prohibited content.

User-Generated Content

Buddy allows users to create and share content, including photos, text, posts, comments, profile information, messages and other media (“User Content”).

You remain responsible for User Content that you submit.

You represent that you have the necessary rights and permissions to submit that content.

You retain ownership of User Content that you own.

By submitting User Content, you grant Buddy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display and distribute that content as reasonably necessary to operate, provide, maintain, secure and improve the Service.

This license does not transfer ownership of your User Content to Buddy.

Adult Social and Relationship Intentions

Buddy may allow adults to indicate different social and relationship intentions, including friendship, travel, activities, nightlife, dating and other consensual adult connections.

These indications do not constitute:

All interactions must be voluntary, consensual and lawful.

Buddy strictly prohibits exploitation, trafficking, coercion, child sexual exploitation and prohibited commercial sexual activity.

• A solicitation for unlawful activity.

Prohibited Activities

You must comply with the Community Guidelines, Prohibited Activities Policy, Content Policy, Safety Policy and Child Safety Standards.

You must not use Buddy to:

• Violate applicable law
• Harass, stalk, threaten or intimidate others
• Impersonate another person
• Operate fraudulent or deceptive accounts
• Commit scams or financial fraud
• Facilitate human trafficking
• Exploit another person
• Facilitate child sexual abuse or exploitation
• Create, upload, distribute or request CSAM
• Facilitate non-consensual sexual activity
• Promote prohibited commercial sexual services
• Send spam
• Distribute malware
• Scrape or harvest personal information
• Circumvent security controls
• Manipulate Buddy's systems
• Operate unauthorized bots
• Sell or transfer Buddy accounts.

Safety

Buddy cannot guarantee the identity, intentions, behavior or safety of another user.

You are responsible for your own decisions when interacting with others.

Users should review the Safety Center and Safety Policy before meeting another person in real life.

Report and Block

Buddy provides mechanisms to report users and content and to block users.

Reports may be reviewed and may result in:

• Content removal
• Warnings
• Feature restrictions
• Account suspension
• Account termination
• Other appropriate action.

Intellectual Property

Buddy, including its software, brand, trademarks, logos, designs, interfaces, technology and proprietary materials, is owned by or licensed to HSW HONG KONG CO. LIMITED.

You may not copy, modify, distribute, reverse engineer or exploit Buddy without authorization.

Buddy Premium

Buddy may offer optional paid subscription services.

The planned standard subscription price is:

THB 174 per account per month.

Buddy may offer free promotional access during the initial launch period.

The duration and eligibility of any promotion will be communicated before a user is charged.

Payments

Subscriptions purchased through Apple App Store or Google Play are subject to the applicable platform billing and subscription terms.

Buddy does not control Apple or Google refund decisions for purchases made through their platforms.

Privacy

Your use of Buddy is subject to the Privacy Policy.

The Privacy Policy explains how Buddy collects, uses, stores, protects and discloses personal data.

Suspension and Termination

Buddy may suspend, restrict or terminate an account where we reasonably believe that:

• These Terms have been violated
• Buddy policies have been violated
• Fraud has occurred
• A user presents a safety or security risk
• Applicable law has been violated.

Disclaimer

To the maximum extent permitted by applicable law, Buddy is provided on an “as available” basis.

Buddy does not guarantee:

• Continuous availability
• Accuracy of user information
• Accuracy of location information
• Successful matching
• User responses
• Particular relationships
• Particular experiences.

Changes to Buddy

Buddy may modify, improve, suspend or discontinue features.

We may update these Terms when reasonably necessary due to product, business, legal, regulatory or security changes.

Governing Law

These Terms are intended to be governed by the laws of Hong Kong, subject to mandatory laws that may apply to you in your jurisdiction.

Specific dispute-resolution provisions may be added following legal review.
